2. Scope

2.1 These Terms and Conditions apply to all orders placed by consumers resident in Ireland through our website www.izimini.com with IZIMINI PTY LTD (“IZIMINI”, “we”, “us”).

2.2 A consumer is an individual acting for purposes wholly or mainly outside their trade, business, craft or profession, as defined in the Consumer Rights Act 2022.

2.3 Our Privacy Policy, Shipping Information and Returns Policy also apply. Our online store runs on the Shopify platform.

3. Placing an order

3.1 Product listings on our website are not a binding offer but an invitation to place an order.

3.2 You can check and correct your details at any time before submitting your order. By clicking “Pay now”, you place a binding order, with an obligation to pay, for the products in your cart.

3.3 We confirm receipt of your order by email. This confirmation is not yet acceptance of your order. The contract is formed when we confirm dispatch of your order by email.

3.4 If we cannot accept your order, for example because a product is unavailable, we will tell you without delay and refund any amount already paid in full.

3.5 The contract is concluded in English. You receive your order details by email and can view and print these Terms on this page at any time.

4. Prices, shipping and delivery

4.1 All prices are in euro and include VAT at the applicable rate.

4.2 Shipping costs may apply and are shown at checkout before you submit your order. Standard shipping is free above the order value stated in our Shipping Information.

4.3 We deliver to the address you give us. Unless a different timeframe is shown on the product (for example, pre-order items), we deliver within 30 days of the contract being formed; usual delivery times are shown in our Shipping Information.

4.4 If a parcel is returned to us because the address was incorrect or it was not collected, we may charge the cost of re-sending it and a handling fee of €10.

4.5 When we reduce a price, the previous price we show is the lowest price we charged in the 30 days before the reduction.

5. Payment

Payment is made using the methods offered at checkout, for example card or PayPal. Payment is due when you place your order. Card details are encrypted in transit and we do not store your full card details.

6. Ownership

Products remain our property until we have received full payment.

7. Your right to cancel

As a consumer, you have a right to cancel distance contracts under the Consumer Rights Act 2022.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last of the goods.

To exercise the right to cancel, you must inform us (IZIMINI PTY LTD, 134-136 Botany Rd, Alexandria NSW 2015, Australia, email: contact@izimini.com) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or an email), or by using the return option in your customer account. 9. Your statutory rights for faulty goods

9.1 Under the Consumer Rights Act 2022, the goods we sell must be of satisfactory quality, fit for purpose and as described. If a fault appears within one year of delivery, it is presumed to have existed at delivery unless we can show otherwise. You can bring a claim for up to six years from delivery.

9.2 If goods are faulty, you may be entitled to reject them and get a refund within 30 days of delivery, to a repair or replacement, or to a price reduction or a refund, as provided by law. We cover the cost of returning faulty goods.

10. Liability

10.1 We are fully liable for death or personal injury caused by our negligence, for loss caused by our wilful misconduct or gross negligence, and under the Liability for Defective Products Act 1991.

10.2 Nothing in these Terms affects your statutory rights as a consumer.

11. Promotions and discount codes

11.1 Welcome discount. New customers who subscribe to our newsletter receive a 10% discount code. It can be used once, on your first order only, once per person, household, email address and payment method, and is valid for 3 days from when it is sent.

11.2 One code per order. Only one discount code can be used per order. Codes cannot be combined with other codes or promotions unless we say otherwise.

11.3 Conditions. Discount codes have no cash value, cannot be applied to past orders, gift cards or shipping unless stated, and are valid only for the period stated. Personal codes must not be sold, transferred or published.

11.4 Codes on third-party sites. We are not responsible for discount codes published on third-party websites such as coupon sites. Codes that are expired, invalid or obtained in breach of these Terms may not work.

11.5 Partial returns. If you return part of a discounted order, we refund the price you actually paid for the returned items.

11.6 Changes. We may change or end promotions at any time; this does not affect orders already placed.

12. Referral programme

12.1 Our referral programme runs through Referrly and is open to approved partners, who are also bound by the programme terms they accept when joining and by Referrly's terms.

12.2 Referral codes are for genuine personal recommendations. Partners must clearly disclose that they earn commission (for example, “#ad”) and must not publish their code on coupon, deal or cashback sites, use it themselves or send spam.

12.3 If a partner breaches these rules, we may deactivate their code, end their participation and withhold commission on sales resulting from the breach. Except for serious breaches, we first give the partner 7 days to respond. Commission on genuine sales made before the breach is paid as usual.

13. Reviews and intellectual property

13.1 If you submit a review, photo or comment, you confirm that it reflects your own genuine experience and does not infringe anyone's rights, and you give us a non-exclusive, royalty-free right to use and display it in connection with IZIMINI. 16. Complaints and dispute resolution

16.1 If you have a complaint, please contact us at contact@izimini.com. We aim to respond within 5 business days.

16.2 As we are based outside Ireland, you can also get free help with cross-border disputes from the European Consumer Centre Ireland (www.eccireland.ie). Information about your consumer rights is available from the Competition and Consumer Protection Commission (www.ccpc.ie).

17. General

17.1 These Terms are governed by Irish law, excluding the UN Convention on Contracts for the International Sale of Goods. This choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you are habitually resident, and you may bring proceedings in the Irish courts.

17.2 The Terms in force when you place your order apply to that order. Changes only apply to future orders.

17.3 If any provision of these Terms is found invalid, the remaining provisions continue to apply and the invalid provision is replaced by the relevant statutory provisions.
